This notice explains how and when we use artificial intelligence tools in our work for clients, the steps we take to protect your information when we do, and what to do if you have questions or concerns.

What these tools are

Artificial intelligence tools generate text by predicting language patterns, and what they generate can be wrong. Lawyers usually call them generative AI. We use them as assistants. They do not make decisions about your matter and they do not practice law.

How we use them

We use AI tools to assist with our work. A member of our team checks everything these tools produce before it becomes part of your file or reaches you. Our lawyers do the legal work on your matter, and they remain responsible for the advice we give and the documents we prepare.

How we protect your information

We use these tools only under business agreements that prohibit the provider from training its models on our information, impose confidentiality obligations on the provider, and limit how long the provider retains data. Personal accounts are never used for client work. We do not enter Social Security numbers, financial account numbers, driver’s license numbers, health insurance numbers, or records from your health care providers into these tools. We ordinarily delete conversations that concern your matter after it closes.

Tools built into the software we use

Some of the software we use to run the firm, such as our email, document storage, and security systems, may include artificial intelligence features as part of how the software works. These features are not something we can separate from the underlying software. We select business-grade providers who are contractually obligated to protect the confidentiality of the information they hold for us.

Meetings

We may record and transcribe our conferences with you so that our record of the meeting is accurate. We record only with your consent, and we ask for that consent before recording begins. If you would rather we not record, tell us and we will take notes by hand instead. We honor that request without exception.

If you use AI tools yourself

Please do not enter our advice or your draft documents into a free or personal AI service. Those services may not keep the information confidential, and sharing it could affect the privilege that protects our communications with you. If you have questions about your documents, please ask us.

Your questions and concerns

Please tell the lawyer handling your matter if you have questions or concerns about how we use these tools. They are now part of how our practice operates, so we do not set them aside entirely for a single matter. We will discuss your concerns with you. If you would rather we not record your meetings, we will always honor that.

Changes to this notice

We will update this notice when we make significant changes to our practices, and the current version will always appear on this page.
